我国公共场所图像监视法律治理路径分析

在过去的近十年中，我国的公共图像监视在政策、项目及资金等支持下得到迅猛发展。在我国特定的政治与社会背景下，公共场所图像监视是社会治安综合治理与公共安全技术防范系统的一个组成部分．呈现出政策创议、项目推动的发展历程。在法律治理和回应性法制视角下，公共图像监视法律治理是对公共图像监视实践的法律回应。目前，我国已初步构建起涵盖宪法、社会治安综合治理法律文件、公共安全技术防范法律文件、具体领域法律文件以及公共场所图像监视法律文件等公共场所图像监视法律治理的体系，但该体系仍然存在急需健全和完善的层面。     

Multinationals as global institution: Power,authority and relative autonomy

This article aims to inform the long‐standing and unresolved debate between voluntary corporate social responsibility and initiatives to impose binding legal obligations on multinational enterprises. The two approaches share a common feature: neither can fully specify its own scope conditions, that is, how much of the people and planet agenda either can expect to deliver. The reason they share this feature is also the same: neither is based on a foundational political analysis of the multinational enterprise in the context of global governance. Such an analysis is essential for providing background to and perspective on what either approach can hope to achieve, and how. This article begins to bridge the gap by illustrating aspects of the political power, authority, and relative autonomy of the contemporary multinational enterprise. The conclusion spells out some implications for the debate itself, and for further research.     

The Greening of the Americas

ABSTRACT

This paper evaluates global capital’s ecological management and extends the assessment to the “green economy,” as developed in the first “green” neoliberal project, in Costa Rica. Costa Rica has been an important “laboratory” for experimentation in environmental governance mechanisms using debt-for-nature financial exchanges and other instruments of the Kyoto Protocol. I explore how “greening” can be understood as a new phase of capital accumulation, as I go into its five main aspects.     

Congressional Attention and Opportunity Structures: The Select Energy Independence and Global Warming Committee

This article examines the role that overlapping committee jurisdictions play in fostering or hindering attention to environmental and energy issues in the U.S. Congress. The Select Energy Independence and Global Warming Committee, created by House Democrats in 2007 , and its chairman Rep. Ed Markey took advantage of opportunities within the existing jurisdictional arrangement to increase attention to these issues despite lacking any legislative authority. Data from the 110th and 111th Congresses show that the Select Committee held more hearings on climate change and alternative energy, and on environmental and energy policy generally, than any other committee. The committee also increased the range of sources informing debate on these issues by calling different witnesses than other committees. These findings have important implications for the relationship between institutional structure and agendas and for Congress' policy‐making role on energy and the environment.     

网络安全的战略选择

随着网络空间的迅速扩张及其对社会各领域的全面渗透,网络空间不断增长的财富、战略价值以及世界经济社会运行对网络空间的深度依赖,使网络空间整体安全问题的重要性日益凸显,网络安全已成为国际社会面临的又一全球性公共问题。网络安全问题虽然属于国家安全范畴内的非传统安全领域,但国家对于安全的偏好没有改变,对安全追求的逻辑路径依旧。从理论的角度看,由于体系压力以及国家对于安全的追求,国家会选择制衡的战略,但在现实中,制衡经常缺位或迟到。受到非传统安全环境影响,地缘战略中分而治之、领土补偿、加强军备、联盟以及平衡手的存在等制衡方式和作用、意义同时发生了变化。细分到网络安全领域,沟通机制的不同、威慑效果不同、行为体的多样、行为判断的困难等特殊性,导致在网络安全领域,国家选择追随或合作将成为更优选择。     

地区安全治理的未来:走向亚洲协调

作者首次提出了"亚洲协调"的概念,讨论了亚洲协调对未来亚洲及太平洋地区安全治理的必要性和长远性。尽管最早的主要国家之间协调(concert of powers)的理论与实践是19世纪的、欧洲的,但是,关于主要国家之间协调(不仅是大国协调)的一般理论却同样可以运用在解决21世纪的亚洲(以及太平洋)的严峻安全挑战和困境上。这些挑战和困境在未来可能会进一步演化为严重的大国之间的对抗甚至冲突。更重要的是,亚洲协调将注定会阻止战争、实现长期和平及维持本地区的经济活力。也就是说,如果亚洲协调明智地和有效地建立并运作起来,到2079年,亚洲以及太平洋将拥有一百年的和平,如同欧洲在1815-1914年拥有的百年和平。从1979年到现在,亚洲地区已经享受了接近四十年的和平。在过去二十多年建立起来的地区或者跨地区的论坛、会议、组织和制度等,反映了治理亚洲地区的权力转移的企图和努力;尽管这些安排相互重叠、尚未彼此兼容,甚至相互竞争,但我们完全可以把它们当做未来亚洲协调的基础。虽然目前的地区安全治理仍然由美国及其同盟体系占据主导地位,但美国也不得不重视复杂的安全地区主义。有不少人建议美国应该以亚洲协调作为未来解决与中国关系的方案。中国已经为建立在经济发展基础上的亚洲和平做出重大贡献。中国已与美国建立"新型大国关系"回应美国的"转向亚洲"。中国在亚洲协调中的地位是中心的和关键的。     

银行危机处置过程中的股东权利限制研究

银行危机处置过程中股东权利限制是危机时期社会规制的需要,规制的原因包括维护金融稳定、预防系统性风险的发生、维护存款者的市场信心和预防股东道德风险发生。但股东权利保护是现代企业制度的核心内容,这就在"限制"与"保护"之间形成矛盾,这是银行生存的不同时期,股东行使权利正当性基础的差别造成的。因此,分析银行运行不同时期股东权行使的正当性基础,是论证银行危机处置期股东权利限制必要性的基础,同时,股东权利的限制必然影响到公司治理中利益相关主体间的权利结构平衡,故从法律规制和银行公司治理结构调整两个方面对"矛盾"的协调提出完善的建议。     

破产企业单位社区再造的治理路径研究--以成都市L社区为例

社会基层治理是国家治理的微观基础,城市社区是社会的基本单元。我国城市单位社区是城市社区的重要组成部分,因地制宜探索城市单位社区治理模式有利于完善城市社区建设、健全社会治理体制、提升国家治理能力。成都市L社区为破产企业单位社区,其治理以党建引领为核心,以共建共治共享为导向,以社区再造为路径,形成了“党委领导、政府负责、社会协同、公众参与、法治保障”的良性治理模式。但现阶段仍然存在社区空间利用率不足、市场化机制缺位、“单位人”动员作用有限、社区居委会负担过重等问题。本文基于实地调研的数据资料,结合社区治理的基本原理,探讨破产企业单位社区向新型城市社区转型的实现路径,即提高社区资源整合度,进一步引入市场机制,激发社会组织活力,减轻居委会行政负担,以提高破产企业单位社区的治理能力。

The EU and the Global Order: Contingent Liberalism

Abstract

Politicians, diplomats and analysts commonly assume that commitment to multilateralism and liberal norms is part of the EU’s very DNA. Increasingly, however, the EU’s commitment to the liberal global order is more selective. We demonstrate the shift to a more contingent liberalism by examining the EU’s recent record in relation to four different challenges: international trade; US leadership; Russian actions in the eastern neighbourhood; and security in the Middle East. We speculate on what this may portend for the EU’s self-identity, European interests and the integrity of the prevailing global order.
